Respondents Mr.Pardesdhia Munda ... for the petitioners Mr.Salim Mohammed ... for the Administration April 27, 2022 [GNC] Item No.21 The petitioners allege that the Tehsildar (Settlement), Port Blair Tehsil has not furnished the report after having conducted the demarcation with regard to the property bearing survey Nos.2382/1. 2382/2 and 2383, totaling to an area of 1118 square metres situated at Shadipur village, under Port Blair Tehsil, South Andaman District.
The records reveal that a notice dated September 6, 2021 was issued to the petitioners to be present at the spot during such demarcation. The date of demarcation was fixed on September 14, 2021. The petitioners allege that the demarcation was done but no report has yet been furnished. Hence, this writ petition has been filed seeking a direction upon the concerned Tehsildar.
It appears that the petitioners have also approached the Assistant Commissioner (Settlement) and Tehsildar (Settlement), Port Blair for supplying the demarcation report.
Such representation has been annexed to the writ petition at page 34.
The writ petition is disposed of with a direction upon the respondent No.3, the Tehsildar (Settlement), Port Blair to dispose of the representation of the petitioner in accordance with law, upon hearing the petitioner as also the other interested parties who may be interested in such process of demarcation. Upon consideration of the records and the submissions of the parties, a reasoned order shall be passed and communicated to them. The entire exercise shall be completed within a period of two months from the date of communication of this order. Needless to mention, this court has not gone into the merits of the claims and counter-claims of the parties. With the above direction, the writ petition stands disposed of.
