Sabir ... for the petitioner Mr. Shatadru Chakraborty Mr. Dibesh Dwivedi ... for the respondent No. 1 April 3, 2024 [AKB] Item No.21 This writ application has been filed with a prayer for necessary direction upon the respondent No. 1/Panchayat Secretary herein to handover physical possession of room/shop No. 5.

In course of hearing, learned counsel appearing on behalf of the petitioner submitted that shop allotted in favour of the petitioner by the Panchayat after observing all formalities and also on depositing of rents, but subsequently it was allotted to third party/respondents No 2 herein.

It is further submitted by the petitioner that one letter was sent addressed to the respondent No. 2 by the Panchayat Secretary for vacating the said room/shop No. 5. Learned counsel appearing on behalf of the respondent No. 1 has submitted that necessary direction may be given to the concerned authority.

Considering all the aforesaid facts and circumstances Panchayat Secretary, Gram Panchayat, Vivekananda Pur, Hut Bay, Little Andaman is directed to take steps in this regard after hearing both the parties i.e. the petitioner and the private respondent No. 2 within four weeks from date. With the aforesaid observation the writ petition is disposed of.
