Tabraiz ... for the respondents April 25, 2022 [Manoj] Item No.3 The petitioner was an Assistant Court Officer in the Circuit Bench of Calcutta High Court at Port Blair. The order of appointment was issued on October 28, 2003. The petitioner continued in the said post till December, 2020 and the petitioner took voluntary retirement with effect from January 1, 2021.

It is the specific contention of the petitioner that by the time the petitioner took VRS from the said post, the petitioner was entitled to two financial up-gradations as per the applicable Modified Career Advancement Scheme. It appears that the petitioner applied for such financial up-gradations on 27th July, 2018 when the petitioner was in service. The said application of the petitioner was forwarded by the learned Registrar, Circuit Bench at Port Blair, to the learned Registrar General, High

Court, Calcutta on two occasions. The petitioner has not yet received any information in this regard.

Under such circumstances, this Court is of the opinion that the Registrar General, High Court, Calcutta must act and proceed on the basis of the application filed by the petitioner and take necessary steps in accordance with law, with the expedition that the matter deserves. This Court has not gone into the merits of the claims of the petitioner. As no affidavit has been called for, the allegations are deemed to have been denied.

The writ petition stands disposed of.
