Tabraiz ... for the respondents April 25, 2022 [Manoj] Item No.2 The writ petition has been filed by an Assistant Registrar (Court) serving at the Circuit Bench of the Calcutta High Court at Port Blair. The petitioner was appointed to the post of Assistant Registrar (Court) sometime in June, 2002. The petitioner has been continuing in the said post since then. As there was no promotional avenue available under the Registry of the Circuit Bench at Port Blair, the petitioner submitted an application on January 30, 2017 for grant of his first financial up-gradation under the relevant scheme applicable.

The said prayer of the petitioner was granted by the Hon'ble the Chief Justice and accordingly, the learned Registrar General, High Court, Calcutta by a letter dated December 21, 20018 communicated the decision for grant of the first financial up-gradation to the petitioner. The said decision was implemented by an order dated January 21,

2019 issued by the learned Registrar, Circuit Bench at Port Blair. The first financial up-gradation was implemented with retrospective effect from June 13, 2010. The petitioner now prays that in terms of the Modified Career Advancement Scheme, on completion of 16 years continuous service in the Registry as on June, 2018, the petitioner should be considered for the second financial up-gradation with effect from June, 2018 as per the ROPA, 2019, which has been adopted by the Calcutta High Court. An application was filed by the petitioner claiming his second financial up-gradation on August 6, 2019. The same was forwarded by the learned Registrar, Circuit Bench at Port Blair to the learned Registrar General, High Court, Calcutta on August 7, 2019. Reminder to that effect was also sent on April 1, 2021. The petitioner is in the dark on this issue.

Under such circumstances, this Court directs the learned Registrar General, High Court, Calcutta to act and proceed on the basis of the application filed by the petitioner and take necessary steps in the matter, in accordance with law and with the expedition that the matter deserves.

This Court has not gone into the merits of the claims of the petitioner. As no affidavit has been called for, the allegations are deemed to have been denied.

The writ petition stands disposed of.
