The petitioner seeks modification of one of the conditions of bail as imposed vide order dated February 10, 2026 in CRM/8/2026, to the effect that the petitioner was directed to meet the Station House Officer, Police Station, Baratang, on each and every day excepting Sunday, which is prohibitive in nature since the petitioner, due to the exigent reason of the physical ailment of his mother, wants to leave the territorial jurisdiction of Baratang Police Station in order to have his mother treated by taking her from his native place at Tamil Nadu to Bangalore in Karnataka.

Learned Public Prosecutor opposes the prayer for modification, particularly on the ground of the gravity of the offence.

However, upon hearing the parties and balancing the convenience of the petitioner with the nature and gravity of the crime alleged against him, the Court is of the opinion that a limited modification of the condition of the bail may be granted by relaxing the necessity to meet the Station House Officer,

Police Station Baratang each and every day. Instead, if the petitioner is directed to meet the Station House Officer once a week, the petitioner will be at liberty to seek permission to leave the territorial jurisdiction the Baratang Police Station from the jurisdictional Court, which liberty has already been incorporated in the conditions of bail.

Accordingly, the CRAN/1/2026 is allowed in part, thereby modifying the condition of bail imposed vide order dated February 10, 2026 in CRM/8/2026 to the limited extent that the petitioner shall meet the Station House Officer, Police Station Baratang, once every week instead of each and every day. It is further reiterated that the petitioner will be at liberty to avail of the provision made in the order of bail by seeking permission from the jurisdictional Court in the event the petitioner has exigency to leave the territorial jurisdiction of the Baratang Police Station.
