This revisional application is directed against the order dated 08.02.2024 passed in connection with Title Suit No. 118 wherein learned Judge refused the application with a prayer for admitting one authentication certificate of a compact disc on the ground of absence of specific pleadings.

The suit was filed with a prayed for declaration of title along with recovery of possession in respect of the subject land by dint of a Registered Will dated 28.12.1990.

Before recording evidence plaintiff filed one application dated 20.09.2023 seeking prayer for admission of authentication certificate of the compact disc.

Mr. Vijay Kumar, learned counsel appearing on behalf of the petitioner, in usual fairness, has submitted that there is no pleading with respect to existence of any compact disc. 5.

In the afore said view of the matter learned Judge rightly recorded his finding as follows:- "It is the settled law that no amount of evidence can be looked into on a plea not raised in the pleadings." 6.

As I find neither any infirmity nor any illegality in the order impugned, the instant revisional application stands dismissed. No order as to any costs.
