The Lieutenant Governor and others ....Respondents Ms. Anjili Nag ... for the petitioners Mr. Shatadru Chakraborty Mr. Ramendu Agarwal ... for the respondents December 16, 2022 [SR] Item No.21 The writ petition has been filed seeking enforcement of the Circular dated 7th June, 1988 issued by the Ministry of Personnel and Public Grievances and Pensions (Department of Personnel and Training).

The petitioners submit that they have been working for eight hours in a day and discharging the same function as a regular employee with the respondent no.4. In reply to their representations that was directed to be considered by a Coordinate Bench Order dated 20th September, 2021 passed in WPA/235/2021 the fourth respondent passed an Order dated 31st March, 2022.

There is some vagueness in the order. The affidavit-inopposition, however, appears to be rather comprehensive and an attempt to improve the impugned order.

Be that as it may, this Court is of the view that the respondent no.4 shall consider specifically as to whether

each of the writ petitioners fulfill those specified criteria for availing benefit of the Circular dated 7th June, 1988 and pass a clear and explicit order mandatorily and positively within a period of two weeks from date. The order that may be passed, be served on learned counsel for the petitioners within seven days thereafter.

WPA/130/2022 stands disposed of and CAN/1/2022 also stands disposed of.

There shall be no order as to costs.
