The petitioner is alleged to the part of a group of individuals, 2 of whose bail applications were rejected by a Coordinate Bench on 11th and 12th December, 2023. Although, learned counsel appearing for the petitioner submits that there was no recovery made from the petitioner and the petitioner's name transpired from a statement of the co-accused, we note that the learned Trial Court has completed the evidence of 23 witnesses from 20th December, 2023 and only 10 more witnesses are left. Considering the rate of progress in the trial, we expect the trial to be completed in the very near feature. If there is any delay in the trial or if the prosecution proposes to bring any more witnesses after the 33 who are already to be examined, the petitioner shall have the option of approaching the court for appropriate relief. CRM (NDPS)/5/2024 is accordingly rejected in terms of the above.

We consider it appropriate to request the learned Trial Court to dispose of the trial as directed by the Coordinate Bench in its orders of 11th and 12th December, 2023. Parties to act on a server copy of this order duly downloaded from the official website of the Hon'ble High Court at Calcutta.
