The State Mr. R. Pradeep ... for the petitioner Mr. Salim Mohammed ... for the State February 09, 2024 [SR] Item No.3 We are not inclined to grant the application for bail. Our view is on the particular facts in the matter and particularly on consideration of the fact that the petitioner is the prime accused in the offence charged under the Official Secrets Act, 1923. The fact that we have granted bail to a co-accused in CRA (DB)/ 2/2024 cannot be a ground for relief since the appellant in that case was on a totally different footing.

We, however, request the learned Trial Court to expedite the trial of the case as far as is possible for the learned Court.

We are informed that the matter has been wrongly recorded in the presentation form since the matter does not involve the provisions of the NDPS Act.

The application made by Shri. Abhishek Kumar Gupta in relation to GR case No. 960 of 2023 and FIR No. 80 of 2023 dated 03.10.2023 PS CCS US under section 359 of the Officials Act is accordingly rejected for the following reasons.
