The Andaman and Nicobar Administration and others Mr. K M B Jayapal ... for the petitioner Mr. V.D.Sivabalan ... for the respondents April 27, 2023 (SR) Item No.26 The father of the petitioners encroached upon the government land comprised in Survey No.109/2 and 132/P measuring an area of 1.000 hectares at Govindapur Village under Mayabunder Tehsil, North and Middle Andaman District way back in the year 1968.

The petitioners, by the instant writ petition, are praying that the licence in respect of the said land be issued in their favour.

Mr. Jayapal, learned counsel or the petitioners submits that the petitioners have given representation to the authorities for consideration of their said prayer.

It appears from the record that such representation of the petitioners dated October 28, 2020 is appearing at page 32 of the writ petition, being Annexure P-4.

The writ petition, being WPA/199/2021 is disposed of by directing the concerned authority, the Deputy Commissioner, Mayabunder, respondent no.3 herein, to consider and dispose of the said representation of the petitioners as expeditiously as possible preferably within a period of six weeks from the date

communication of this order in accordance with law and shall communicate his decision to the petitioners. There shall be no order as to costs.

Since no affidavit has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent certified copy of this order, if applied for, be supplied to the learned advocates for the respective parties upon compliance of usual formalities.
