Mr. Ananda Halder ... for the petitioner Mr. Rakesh Kumar ... for the respondent June 29, 2022 [SR] Item No.28 The petitioner complains of failure on the part of the respondent authority in not considering a representation of the writ petitioner dated 26 August, 2021, being Annexure P-4 to the writ petition.
It is submitted on behalf of the petitioner that the petitioner seeks mutation in respect of the property which belong to his father (since deceased). The respondent authority is represented and submits that there are two civil suits pending in respect of the subject premises which have been filed by other heirs of the deceased father. In view of the aforesaid, WPA/164/2022 is disposed of by directing the respondent authority and more particularly, the Tehsildar, Port Blair, South Andaman to consider and dispose of the representation of the petitioner dated 26 August, 2021, being Annexure P-4 to the petition,
strictly in accordance with law within a period of eight weeks from the date of passing of this order. It is submitted on behalf of the petitioner that there is no civil suit pending in respect of the subject premises. It is made clear that the Tehsildar will not be influenced by any observation of finding in this order in so far as the merits of the representations are concerned. ( Ravi Krishan Kapur, J.)
