Salim ... for the respondents March 15, 2022 [GNC] Item No.9 This is an application under Article 226 of the Constitution of India wherein the writ petitioner was aggrieved by the inaction on the part of the appropriate authority to refer the matter under section 10(1) of the Industrial Disputes Act, 1947. I have heard learned counsel appearing on behalf of the parties.

I am of the view that the respondent No.3, being the Secretary (Labour), Andaman and Nicobar Administration should be directed to decide whether the matter should be referred under section 10(1) of the Industrial Disputes Act, 1947 subsequent to filing of the failure report. The respondent No.3 is directed to decide on the issue as to whether reference lies or not, within a period of six weeks from date.

In light of the above directions, this writ petition is disposed of.
