Learned counsel appearing on behalf of the petitioner submits as follows. By an order 16th March, 2021 passed by a Coordinate Bench of this Court, a retired Judge of this Court was appointed as the Sole Arbitrator. The tenure was extended by mutual consent. However, the arbitration proceeding has not been concluded yet. It is at the stage of arguments. But, the extended mandate would come to an end on 25.02.2024. Therefore, it is necessary that an order be passed extending the time for the learned Arbitrator to conclude the arbitration proceeding.
Learned advocate appearing on behalf of the respondents submits that an appropriate order may be passed in this regard. It appears that the arbitration proceeding is now at the stage of arguments.
In view of the fact that the arbitration proceeding, albeit at a mature stage, has not been concluded yet, let the term of the learned Arbitrator be extended by another six months so that the arbitration proceeding can be concluded within such time. With these observations, the application being CAN/1/2024 is disposed of.
