This Writ application was filed challenging the tender process of Port Blair Municipal Council for re-allotment of the shops.

In course of submission learned Advocate appearing on behalf of the Respondents has referred to the order of Municipal Council dated 21st October, 2020 whereby Municipal Council cancelled the allotment of 37 number of shops including that of the father of the petitioner. Learned Advocate has further referred to a public notice published in The Daily Telegrams showing sealing of those shops for default of payment of arrears rent.

In this conjecture, learned Advocate appearing for the respondents filed one letter written by the writ petitioner i.e. son of the allottee of the shop addressed to the Secretary, Port Blair Municipal Council stating inter alia that he had withdrawn the said case. However, tone and tenor of the application addressed to the Secretary, Port

Blair Municipal Council is clear about the intention of the writ petitioner not to proceed with this Writ application further.

In the aforesaid view of the matter the Writ application stands dismissed.
