Binoy Krishna Roy v. The Union Of India And ORS
IN THE HIGH COURT AT CALCUTTA
[ CIRCUIT BENCH AT PORT BLAIR ] *** WPA/157/2024 Binoy Krishna Roy Vs The Union of India Mr.Debasish Roy (through virtual mode] Mr. Phiroj Edulji Mr.Vivekananda Bose Mr.Avik Ghatak Mr.Soham De Dhara Mr.Ratikanta Pal ... for the petitioner Mr. Shatadru Chakraborty Mr. Dibesh Dwivedi ... for the respondents August 5, 2024 [SR] Item No.04 It appears that the writ petitioner approached this Court challenging a notice issued by the Investigating Officer summoning him for the purpose of investigation. However, a report has been filed by the Investigating Officer that no cognizable offence has been committed by the writ petitioner.
Mr. Debasish Roy, learned Senior Advocate representing the writ petitioner says that the writ petition has become infructuous. However, the past conduct of the defacto complainant shows that he is all out to harass the writ petitioner. Therefore, liberty should be reserved to the petitioner to approach this Court, if the same becomes necessary in future. The writ petitioner always has such liberty.
WPA/157/2024 is disposed of accordingly.
