IN THE HIGH COURT AT CALCUTTA

SPECIAL JURISDICTION ss CIRCUIT BENCH OF PORT BLAIR C.P.A.N. 7 of 2022 In W.P.A. 74 of 2022 I.A. CAN 1 of 2022 Samir Dhara & ors.

Vs.

D. K. Joshi & ors.

Mr. Arul Prasanth ... for the applicants/petitioners Mr. Shatadru Chakraborty Mr. Ramendra Agarwal Ms. Mobina Ali ... for the alleged contemnors Heard learned Counsel appearing for the parties. Affidavit of compliance filed by the alleged contemnors is taken on record.

It appears from the affidavit of compliance that as per direction of this Court, posts have been created by an order dated 2nd August, 2022. With regard to interim payment to be made to the petitioners, an order has been passed by the Deputy Secretary, Law, rejecting the representation of the petitioners.

In my view, no further order needs to be passed in the contempt proceeding. Any other grievance the petitioners may have that should be addressed by them by way of appropriate proceeding before the appropriate forum.

The issue regarding absorption of the petitioners into the sanctioned posts has to be taken by the petitioners in accordance with law and the same cannot be mandated in a contempt proceeding.

Accordingly, the contempt petition is disposed of. (Shekhar B. Saraf, J.) <
