Vinita Devi .... for the petitioner [on behalf of Mr.Gopala Binnu Kumar] Ms. A.S.Zinu ... for the State February 28, 2024 [SR] Item No.4 This is an application seeking speedy disposal of trial in G.R.Case No.1639 of 2014 pending before the learned Judicial Magistrate First Class-I, South Andaman District at Port Blair. Learned counsel appearing for the petitioner submits as follows. The petitioner is an accused in the instant case. On 08.11.2014 an FIR was lodged against him under sections 451/365/323/34 of Indian Penal Code and under sections 128/177 of the Motor Vehicles Act. He was arrested on the same day and he was granted bail on 10.11.2014. After completion of purported investigation, a charge sheet dated 02.02.2015 was submitted citing 17 witnesses. Subsequently, charges were framed. Yet, till date, only 3 witnesses out of a total of 17 witnesses could be examined by the prosecution. Trial has remained pending for no fault of the petitioner.

Learned counsel appearing on behalf of the State submits that there were some procedural delays in the instant case. It appears that although FIR was registered on 08.11.2014, in spite of submission of charge sheet in 2015, till date, only 3 witnesses out of 17 could be examined.

In view of the above and in the interest of justice, the learned Trial Court is directed to conclude the proceedings as expeditiously as possible, without granting any unnecessary adjournment to any of the parties, preferably within a period of one year from the next date of hearing.

With these observations, the revisional application is disposed of.
