Respondents Mr.N.K.Mishra, Advocate ... for the petitioners Mr.Krishna Rao, Advocate ... for the respondents September 10, 2021 [GNC] Item No.10 The petitioner claims to be the recorded tenant of survey plot No.82/P/1 measuring .0500 square meters at Austinabad village, under the Port Blair Tehsil, South Andaman District and applied before the Tehsildar for demarcation on the said land in order to avoid any dispute in future. The said application was made as far back as on 27th September, 2018 but till date no action has been taken by the said authority.

Mr.Rao, learned Government Pleader for the respondents showed his inability to apprise the Court the reasons for such delay.

After hearing respective counsels and on perusal of the material, this Court finds that the moment the application of such nature is filed and it is a duty of the Tehsildar to take an appropriate steps thereupon, such duties and responsibilities cannot be avoided.

The Tehsildar, Port Blair is directed to consider the said application and dispose of the same by taking a suitable steps within four weeks from the date of communication of this order in accordance with law. With such observation this writ petition is disposed of.
