Respondents Mrs. Anjili Nag ... for the appellant Mr. Rakesh Pal Gobind ... for the respondent June 29, 2022 [AKB] Item No.15 This is an appeal against the order dated 8th February, 2022 passed by the Learned Judge Family Court, Port Blair dismissing the application under 13 (1) (i-a) (i-b) of the Hindu Marriage Act 1955 (the impugned order). By the impugned order, an application for divorce filed by the plaintiff/husband has been dismissed primarily on the ground that the learned Trial Court has found no convincing evidence of cruelty or desertion or any ground under the Act.
Being aggrieved by the impugned order, the appellant has filed this appeal. Pursuant to the orders of this Court, the parties were directed to arrive at a settlement. A Memorandum of Understanding dated 29th June 2022 is filed and is taken on record. It appears from the said Memorandum of Understanding that the parties have
unequivocally and categorically admitted to resolve their disputes and differences by filing and appropriate application under Section 13 (B) of Hindu Marriage Act and also agreeing on the maintenance payable to the appellantwife. In view of the Memorandum of Understanding, nothing survives in this appeal.
FA/1/2022 stands disposed of in view of the Memorandum of Understanding dated 29th June, 2022 filed in Court.
