Leave is granted to the petitioner to correct the first page of the application so as to incorporate the relevant provisions of the Bharatiya Nagrik Suraksha Sanhita, 2023 (in short BNSS 2023) in the cause title.

The present application has been filed, inter alia, praying for a direction upon the learned Judge, Family Court, South Andaman District at Port Blair to expeditiously hear out and dispose of the Misc Case No. 80 of 2023 filed under Section 125 of the Code of Criminal Procedure.

The opposite party is represented.

Taking note of the fact that the application for grant of maintenance is pending since 20.11.2023 and also gathering from the parties that their respective affidavit of assets and liabilities though not filed is ready, I propose to dispose of the instant application by directing the parties to file affidavit of assets and liabilities before the learned Judge, Family Court positively within a period of ten days from date. The opposite
party shall also be at liberty to file any written objection unless the same has already been filed, within the aforesaid period with a further request to the learned Judge, Family Court to take up hearing of the application being Misc. Case No. 80 of 2023 and to dispose of the same as expeditiously as possible, preferably within a period of two months from the date of communication of this order.

The learned Judge, Family Court is also requested to refix the date of hearing of the application not later than 01.04.2025.

With the above observations and directions, the revisional application CRR/22/2025 is disposed of.

There is no order as to the costs.

Urgent Photostat certified copy of this order if applied for, the same be supplied to the parties upon compliance of necessary formalities.
