The petitioners claim that they are entitled to 1/30th of minimum pay scale payable to the regular employees including dearness allowance in terms of the circular of the Administration.

The Zilla Parishad, South Andaman has denied the same on the ground that they are contractual employees. Affidavits have been exchanged and Mr. Gopala Binnu Kumar, produces, in his reply, documents showing that they have signed in muster roll which has been countersigned by the Assistant Engineer of the Zilla Parishad.

This Court is of the view that there are several disputed questions of facts the instant Lis must be decided by the authorities under the Industrial Disputes Act, 1947.

With liberty reserved to the petitioners and similarly situated persons to approach the authorities under the Industrial Disputes Act, 1947, the writ petition is disposed of without any order as to costs.
