The Andaman and Nicobar Administration and Others Ms. G. Mini .... for the petitioner Ms. Babita Das ... for the respondents March 19, 2024 [AKB] Item No.9 It is the grievance of the petitioner that she is the recorded tenant in respect of a land bearing survey No. 494 measuring about 200 sq.mtrs. A portion of the land, measuring about 80 sq.mtrs., was acquired by Andaman Public Works Department for construction of a cement concrete footpath in the year 2006-07 without due process of law and without any payment of compensation. The petitioner initiated RC case no. 153/2014 before the Deputy Commissioner, South Andaman, Port Blair seeking compensation and an alternative land against such illegal acquisition.

The petitioner has made repeated representations before the Deputy Commissioner, South Andaman, Port Blair, but till date the case has not been disposed of.

I do not see any justification to keep this writ petition pending. Accordingly I disposed of WPA/191/2024 with a direction upon the Deputy Commissioner, South Andaman, Port Blair to consider the representation dated January 8, 2024, and disposed of the same by passing a reasoned order within a period of three months from date of communication of this order. The Deputy Commissioner, South Andaman, Port Blair shall afford an opportunity for hearing to the petitioner and all other concerned before taking such decision.

Accordingly, WPA/191/2024 is disposed of.
