The Deputy Commissioner and another ....Respondents Mrs. Anjili Nag, Advocate ... for the petitioners Mr. Arul Prasanth, Advocate ... for the respondents November 22, 2021 [SR] Item No.1 It appears from the documents annexed to the writ petitions that by an order dated 22nd March, 2021, in WP No.094/2021 a Coordinate Bench of this Court was pleased to set aside the impugned order dated 18th February, 2021 passed by the Deputy Commissioner, South Andaman with the observation that the same was passed in violation of the principle of natural justice. Liberty was granted to the respondents to proceed afresh against the petitioner after affording due opportunity of hearing. The requisite exercise was directed to be completed within a period of three months from the date of receipt of a copy of the order. The order of the Court was duly communicated to the Deputy Commissioner by a communication dated 1st April, 2021.

From the submissions of the parties, it appears that the liberty which was granted by the Court has not been acted upon by the respondents till date.

In view of the above, the Deputy Commissioner, South Andaman is directed to act in strict compliance of the direction passed in the order dated 22nd March, 2021.

The requisite exercise shall be completed immediately without any unnecessary delay.

The writ petition being WPA/251/2021, stands disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of usual necessary formalities. (Amrita Sinha, J.)
