Case No. 903 of 2022 under Section 420/34 of the Indian Penal Code, the present application has been preferred. Mr. Jayapal, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in a dispute which is civil in nature. He is cooperating with the Investigating Officer and in the said conspectus his custodial interrogation may not be necessary.

Mr. Salim Mohammed, learned advocate appearing for the State opposes the petitioner's prayer and submits that there are incriminating materials on record against him and the investigation is still continuing.

Records reveal that the petitioner was granted interim bail by a Coordinate Bench of this Court on 23rd February, 2023. The said interim protection was extended thrice on 14th March, 2023, 17th April, 2023 and 19th June, 2023.

Mr. Jayapal submits that the petitioner has complied with the earlier direction passed by this Court and is cooperating with the investigation. Such submission has not been disputed by Mr. Salim Mohammed, learned advocate appearing for the State. Considering the nature of allegations, the extent of complicity of the petitioner in the alleged offence and his conduct, we are of the opinion that custodial interrogation is not necessary. Accordingly, we direct that in the event of arrest the petitioner namely, T.R.Rajendran be released on bail upon furnishing bond of Rs. 10,000/- with two sureties of like amount

each, one of whom must be local, to the satisfaction of the arresting officer.

Till the investigation is complete, the petitioner shall meet with the Investigating Officer once a week and shall not leave the Islands.

The application, being CRM(DB)/4/2023 is, accordingly, disposed of.
