Respondents Mr. Pradeshia Munda ... for the petitioner Mr. VD.Sivabalan Mr. M.Lakshmanan ... for the respondent July 21, 2022 [MAM] Item No.3 The grievance of the petitioner is that in spite of application being made under section 95 of the Andaman and Nicobar Islands Land Revenue and Land Reforms Regulation, 1966, the documents sought for in said application has not yet been supplied by concerned Tehsildar. The further grievance of the petitioner is that the said Tehsildar has not taken any steps for demarcating the boundary of the house site bearing survey no. 348 measuring an areas of 340 sq. mtrs. Situated at Bimblitan village under Port Blair Tehsildar.
After hearing learned advocates for the parties and upon considering materials on record this Court is of the considered view that the interest of justice would be sub served if the concerned Tehsildar is directed to consider the representation of the petitioner dated December 1, 2014 and the representation for demarcation of boundaries dated September 24, 2021 within a specified time frame. Accordingly, the Tehsildar, Port Blair Tehsil being respondent No. 3 herein is directed to consider the representations of the petitioner dated December 1, 2014 and September 24, 2021 and to take steps in terms of the prayer contained in the aforesaid representations as expeditiously as possible, but positively within a period of six weeks from the date of communication of this order to the respondent no. No.3 herein.
Since no affidavits have been called for the allegations contained in the writ petition shall not be deemed to have been admitted by the respondent.
WPA 230 of 2022 is disposed with the aforesaid direction.
