Respondents Ms. Shipra Mandal ... for the petitioner Mr. Rakesh Kumar ... for the respondent July 21, 2022 [MAM] Item No.4 The grievance of the petitioner is that the petitioner has not been provided with domestic water tap connection at the place of his residence at Kakapathar village,Ward No. 2, Brindaban Panchayat under Ferrarguanj Tehsil, South Andaman.

The petitioner has applied in prescribed format on June 7, 2022.

The learned advocate appears for the petitioner and submits that till date neither water tap connection has been effected nor any decision on the application of the petitioner has been communicated to him.

Heard the learned advocate for the parties. Since the petitioner has applied for water tap connection and same is still pending consideration before the Assistant Engineer, Ferrarguanj Sub Division, this Court is of the considered view that interest of justice would be sub served if the said respondent is directed to consider the said representation and to dispose of the same within a specified time frame. Accordingly WPA/234/2022 is disposed of by directing the Assistant Engineer, Sub Division, APWD, Ferrarguanj Tehsil being respondent No.

2 herein to consider the application of the petitioner dated June 7, 2022 which is appearing at page 17 of the writ petition and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner or his authorised representative and to communicate the same to the petitioner. The entire exercise shall be completed within a period of three weeks from the date of the communication of this order. In the event the said authority is of the view that the petitioner is entitled to water tap connection the same is to be given to the petitioner forthwith.

Since no affidavits have been called for the allegations contained in the writ petition shall not been deemed to have been admitted by the respondent.

Urgent photo stat certified copy, if applied for, be supplied to the parties upon compliance of all requisite formalities.
