Petitioner submits that, due to pendency of the criminal case, he is not in a position to work in these islands. He seeks expeditious disposal of the criminal case pending as against him. State is represented.

The trial in the criminal case started on and from March 28, 2022. Court is informed that there are about 19 prosecution witnesses. Apparently, only one prosecution witness was examined till date and that too, not completely.

From the order dated March 07, 2024, it appears that, next date for recording of the evidence of deferred prosecution witness is fixed on August 16, 2024.

In view of the long pendency of the police case and in view of the prejudice that the petitioner before the Court is suffering, it would be appropriate to request the learned Trial Judge to fix consecutive dates of trial on and from August 16, 2024. Learned Trial Judge is requested to invoke the provisions of section 309 of the Code of Criminal Procedure in this regard.

Learned Trial Judge is requested not to grant unnecessary adjournments to any of the parties.

CRR/35/2024 is disposed of accordingly.

Since affidavits are not called for, allegations made in the revisional application are deemed to be denied. ( Debangsu Basak, J. )
