An application has been filed by the petitioner praying for setting aside the ex parte order dated 05.11.2024 and to restore the writ petition to its original position.

The subject order appears to have been passed on merit upon hearing the parties.

The Court is of the opinion that such prayer cannot be allowed by a Coordinate Bench and the appropriate remedy of the petitioner ought to be before the Hon'ble Division Bench. 4.

In view of the above, the application being CAN/1/2024 stands dismissed.

It will be open for the petitioner to take appropriate recourse to law for challenging the order dated 05.11.2024. 6.

The original certified copy annexed to the application be returned to the learned advocate for the petitioner by retaining a photocopy thereof.
