Respondents are represented.

Apparently, petitioner applied on August 20, 2018 for acceptance of the premium for the landed property bearing Survey No.5A/151/6 comprising an area of 34 Sq.mtrs situated at Haddo Village under Port Blair Tehsil. File regarding regularization of the Pre-78 encroachment cases was prepared. The proceedings are yet to be concluded.

In such circumstances, it would be appropriate to request the respondent no.2 to consider and dispose of the case as expeditiously as possible and preferably within six weeks from the date of communication of this order to him. Needless to say that, the respondent no.2 will afford a reasonable opportunity of hearing to the petitioner. He is at liberty to hear such parties and consult such documents as he deems appropriate and pass a reasoned order and communicate the same forthwith thereafter.

Since the Court did not call for filing affidavits, allegations made in the writ petition are deemed to be denied by the respondents.

WPA/214/2024 is disposed of without any order as to costs. ( Debangsu Basak, J. )
