IN THE HIGH COURT AT CALCUTTA

Civil Appellate Jurisdiction [ CIRCUIT BENCH AT PORT BLAIR ] ...

MA/10/2022 IA No.CAN/1/2022 Manoj Paul ... Appellant Vs.

Union Territory, Administration of Andaman and Nicobar Islands and another ... Respondents Mr. Manoj Paul ... Appellant (in person) Mr. Shatardru Chakrabory Mr. Ramendu Agarwal ... for the respondents July 22, 2022 [SR] Item No.2 The appellant, appearing in person with leave of Court, submits that the appellant is being regularly harassed by several authorities in the Islands, for which the appellant had to take recourse to criminal action. False FIRs, it is alleged, were lodged against the appellant, since the appellant sought to expose certain corruption.

It is submitted that the learned Trial Judge ought to have passed a direction on the authorities to give adequate protection to the appellant.

Such contentions have been controverted by learned Counsel appearing for the respondent authorities. It is submitted by the respondents that already adequate protection has been given to the appellant by virtue of orders of Court.

That apart, it is submitted that there is no illegality in the impugned order. Upon perusal of the order impugned herein, we find no illegality or patent irregularity in the order sufficient to justify interference in an intra-court appeal. However, needless to say that it will be open to the appellant to explore all avenues within the frame-work of law, if the petitioner/ appellant have any allegations against any of the authorities and/or regarding any alleged illegality in the criminal proceeding. Hence, without going into the merits of the allegation and counter allegation raised herein, MA/10/2022 is disposed of without any order as to costs.

The connected application being, CAN/1/2022, is disposed of accordingly.

Urgent Photostat certified copy of this order be supplied to the respective parties upon compliance of usual formalities. ( Sabyasachi Bhattacharyya, J. ) ( Hiranmay Bhattacharyya, J. )
