Jayapal ... for the respondent Nos. 3 to5 June 11, 2025 [AKB] Item No.8 This revisional application is filed for setting aside the order No. 94 dated 22.11.2025, order No. 96 dated 28.11.2023, Order No. 98 dated 13.06.2024, Order No. 100 dated 26.12.2024 and order No. 101 dated 07.02.2025 and for direction upon the learned trial court to dispose of the suit being Title Suit No. 131 of 2011 with a specified time pending before Joint Civil Judge, Senior Division, Port Blair.
Mr.
N.A.Khan, learned advocate appearing for the petitioner/defendant No.4 submits that the trial before the learned trial court is being deferred and delayed at the instance of the plaintiff and other defendants. He seeks for expeditious disposal of the suit.
On the contrary Mrs. Anjili Nag, learned senior advocate appearing for the plaintiffs-respondent Nos. 1 & 2 submit petitioner-defendant No.4 as well as other defendants are taking time to cross examine the plaintiff's witness namely PW 1, which has resulted in delay in the trial.
Mr. KMB Jayapal, learned advocate appearing for the respondent Nos. 3, 4 and 5 leave the matter to the discretion of the court.
Upon going through the order sheets annexed to the revisional application it is found that adjournments are being taken by either of the parties including the petitioner herein. The cross-examination of plaintiff's witness namely PW 1 is yet to be
concluded. The suit is filed in the year 2011 and issues are framed in the year 2013.
Bearing in mind the aforesaid, the learned trial court is directed to expedite the trial and dispose of the same at an early date.
Plaintiffs as well as defendants are directed to cooperate in the trial during examination of the witnesses. With the aforesaid observation the civil revisional application being CO/24/2025 is disposed of.
Interim order, if any, stands vacated.
All connected application, if any, stand disposed of. Parties are at liberty to communicate this order to the learned trial court.
