This is an application seeking restoration of the writ petition being WPA/224/2025 which has been dismissed for default by an order dated 18.02.2026 by the Coordinate Bench of this Court.

The learned counsel appearing for the applicant submits that on the said date the matter has been called for hearing, the conducting advocate could not appear due to the reasons explained in paragraph 3 of the said application. The learned counsel for the applicant submit that the non appearance has neither been intentional nor deliberate.

Having heard the parties and upon perusing the records this Court finds that sufficient cause has been shown for the non appearance of the petitioner. In the interest of justice, the parties should be allowed to contest the matter on its merits rather being shut out on the technical grounds.

In view of the above CAN/1/2026 is allowed and disposed of.

RE:WPA/224/2025 5.

WPA/224/2025 is restored to its original file and number.

Let this matter appear on the next Circuit Bench. In the meantime, the private respondent is directed to act in terms of the order dated 9th November, 2025 and copy of the same shall be circulated amongst the respective parties. (Smita Das De, J.)
