This is an application under Article 226 of the Constitution of India wherein the order dated November 18, 2021 passed by the Tehsildar has been assailed.

The Court has gone through the records of the Administration and it appears from the records that the petitioners were not present on the date of the main hearing. Mrs.Nag, counsel appearing on behalf of the Administration has fairly conceded the said point.

In light of the same, the impugned order dated November 18, 2021 is quashed and set aside with a direction upon the authority concerned to grant another opportunity of hearing to the petitioners and pass a reasoned order within a period of three weeks from date in accordance with law. With the above directions, this writ petition is disposed of. ( Shekhar B. Saraf, J. )
