Respondents Mr. Pradeshia Munda ... for the petitioner Mr. Rakesh Kumar Mrs. Preeja Menon ... for the respondents July 29, 2022 [MAM] Item No.8 The petitioner claims to be residing along with her family in a Government revenue land bearing survey No. 203/P measuring an area of 200 Sq. mtrs. Situated at Calicut Village under Port Blair Tehsil in the District of South Andaman.

The petitioner applied for water tap connection by filling an application dated May 19, 2022.

The grievance of the petitioner is that the concerned authority has not taken any steps pursuant to the said application.

The respondents are represented through its learned advocate, who submits that the authority will communicate its decision to the petitioner within a period of four weeks from date.

In view thereof WPA No. 309 of 202 is disposed of by directing the Executive Engineer, Public Health Engineering Division, APWD department Prothrapur being respondent No.2 herein to consider the application of the petitioner dated May 19, 2022 which is annexed as annexure P4 at page 23 of the writ petition and to dispose of the same as expeditiously as possible but positively within a period of four weeks from date of communication of this order after giving opportunity of hearing to the petitioner or her authorized representative and to communicate the same to the petitioner.

If the said respondent is of the view that the petitioner is entitled to water tap connection and has complied with all formalities in that regard, such connection shall be given to the petitioner immediately thereafter.

It is, however, made clear that this order shall not create any right and/or equity in favour of the petitioner with regard to the title of the property in question. (Hiranmay Bhattacharyya, J.)
