Jayapal ... for the petitioner Ms. Babita Das ... for the respondents June 16, 2025 [AKB] Item No.8 This writ petition is filed seeking a direction upon the respondent authorities to determine and notify the quantum of premium payable by writ petitioner as per licence in connection with land in survey no. 179/P measuring an area of 1.00 Hectare situated at village Pahargoan, under Port Blair Tehsil (Now Sri Vijaya Puram).

The petitioner contends that petitioner is in occupation of the aforementioned land in question. A licence of occupation of agricultural land was issued in favour of the father of the petitioner. The petitioner has made several representations and lastly on 06.02.2023 submitted representation for mutation of her name in respect of land in question. However, the same has not yet been disposed of. Hence this writ petition.

Mr. KMB Jayapal, learned advocate appearing for the petitioner submits that necessary direction be issued to the respondent authorities to determine and notify the quantum of premium payable by the petitioner in respect of land in question. Ms. Babita Das, learned advocate appearing for the respondent authorities informs the Court that pursuant to the representation made by the petitioner Revenue Case being No. 922/Sett/2023/473 has been initiated by the respondent No. 3, Assistant Commissioner (Sett.) which is still pending. She seeks that necessary direction be issued upon respondent no. 3 for disposing the aforementioned Revenue Case within a time frame. In view of the above, the writ petition is disposed of directing the respondent No.3, Assistant Commissioner (Sett.) to dispose of the RC No. 922/Sett/2023/473 upon notice to the petitioner within a period of one month from the date of communication of

this order. The petitioner is granted liberty to produce all relevant documents at the time of hearing.

Learned advocate appearing for the petitioner is directed to communicate this order to the respondent No.3, Assistant Commissioner (Sett.) for necessary compliance. Since no affidavit has been called for, the allegations made in the writ petition are deemed to be not admitted. It is made clear that this court has not gone into the merits of the writ petition.

Accordingly, with the aforesaid direction the instant writ petition being WPA/257/2025 is disposed of.

Interim order, if any, stands vacated.

All connected application, if any, stand disposed of. Urgent Photostat certified copy of this order if applied for be supplied to the parties upon compliance of all necessary formalities.
