IN THE HIGH COURT AT CALCUTTA

Constitutional Writ Jurisdiction Appellate Side [ CIRCUIT BENCH AT PORT BLAIR ] ...

WPA/312/2022 N. Tamil Selvi ... Petitioner Vs.

The Superintending Engineer and others ... Respondents Mr. Rakesh Kumar Mrs. Preeja Menon ... for the respondents July 29, 2022 [SR] Item No.10 None appears for the petitioner when the matter is called on for hearing although the respondents are represented through counsel.

It appears from the writ petition that the writ petitioner has sought electricity connection on the strength of an agreement entered into by the writ petitioner. Learned counsel for the respondents points out that such agreement, by itself, does not create any present title in the property. Be that as it may, since there is scope of objection being raised by the actual owner of the property, WPA/312/2022 is disposed of by directing the respondent no.3 to give electricity connection to the petitioner at the premises subject to the respondent no.3 being satisfied that there is no hindrance otherwise for giving such connection, that the petitioner is in settled occupation of the property in question and subject to

compliance of all formalities by the petitioner, as early as possible after the formalities are complied with. No order as to costs.

Urgent Photostat certified copy of this order be supplied to the respective parties upon compliance of usual formalities. ( Sabyasachi Bhattacharyya, J. )
