Vijay Kumar ... for the petitioner June 18, 2026 [AKB] Item No.11 A suit for partition filed sometime in the year 2014 was pending adjudication before the Court of the learned Civil Judge, Senior Division at Port Blair. The suit was transferred to the Court of the Joint Civil Judge Senior Division, Port Blair sometime in 2015.

Title suit is now numbered as TS No. 2 of 2015. The learned Joint Civil Judge Senior Division, Port Blair had referred the matter to mediation on August 27, 2019. It seems from the order sheet that the mediation has failed between the parties.

Since July 2023, the matter has been adjourned, simply on the ground of seeking report from the mediator. The mediator has acted in a lackadaisical manner and not filed the report thereby frustrating the very essence of mediation, that of expeditious disposal of cases.

The Joint Civil Judge Senior Division, Port Blair is directed to immediately proceed with the Title Suit No. 2 of 2015, without waiting for the mediation report to be submitted

and without giving any unnecessary adjournments to any of the parties.

The suit should be heard and disposed of by December 15, 2026.

With the aforestated directions, the civil revisional application is disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis on compliance of all legal formalities.
