The petitioner seeks a modification of the conditions imposed at the time of grant of bail. One of the primary premises of such prayer is that the petitioner's mother, who resides in the State of Uttar Pradesh, has suffered a fracture recently and requires immediate medical attention, which necessitates that the petitioner visits her or at least establishes contact with her independently and not through the concerned Station House Officer (SHO). It is alleged that the SHO is not permitting the petitioner to contact his family as per previous direction of Court.

In order to decide such position comprehensively in the light of the other circumstances, we grant leave to the petitioner to file a supplementary report disclosing the composition of his family in Uttar Pradesh, with an advance copy to the learned Public Prosecutor.

The matter shall next be listed in the next Circuit.

We make it abundantly clear that we have not touched upon the merits of the application at all at this stage. 5.

On the returnable date, the State shall also file a report disclosing the conduct of the petitioner during the period of his incarceration, with an advance copy of learned counsel for the petitioner. In the above report, the State shall also disclose the current stage of the trial.

We further clarify that the liberty given to the petitioner vide order dated November 13, 2024 in CRM(DB)/7/2024(IA CRAN/1/2024) to contact his family through the phone of the concerned SHO shall be implemented and given full effect to by all concerned.
