The Executive Engineer (SA) Mr. Ajay Majhi ... for the petitioner June 21, 2024 [SR] Item Nos.2 Despite service, none appears for the respondent. Affidavit of service filed today be kept with the record. The petitioner applied for electricity connection but the same has not yet been processed by the respondents. Upon perusal of the annexures to the writ petition, it transpires that the petitioner has furnished prima facie material to establish his possession of the property.

It is well-settled that under Section 43 of the Electricity Act, 2003, a person in settled occupation of a property is entitled to get electricity connection.

Accordingly, WPA/279/2024 is disposed of by directing the respondents to give an electricity connection, subject to compliance with all formalities otherwise by the petitioner, positively within a fortnight from the date of such compliance. If not already issued, the respondent shall issue an offer letter to the petitioner within three days from the date of communication of this order to the petitioner. No order as to costs.

Urgent certified server copies, if applied for, be issued to the parties upon compliance of due formalities.
