Mini ... for the petitioner Ms. Babita Das ... for the respondents June 20, 2025 [AKB] Item No.5 This writ petition is filed seeking direction upon the respondent authorities to dispose of the representation of the petitioner dated 28.10.2024 by sub dividing the land under Survey No. 420/3 measuring an area of 0.1000 hectares situated at Mannarghat village under Ferrargunj Tehsil, South Andaman District.
Ms. G.Mini, learned advocate for the petitioner submits that as per Citizen Charter of Deputy Commissioner, South Andaman such sub-division of the land is required to be made within a period of sixty days from the date of receipt of the application. The petitioner along with three other co-tenants made an application on 28.10.2024. However, despite receipt of such application no steps has been taken. She seeks for specific direction upon the respondent authorities for disposal of the representation of the petitioner dated 28.10.2024 within a time frame. Ms. Babita Das, learned advocate for the respondent authorities submit that pursuant to such representation of the petitioner a revenue case being RC No. 155/GIS/2024/DC (SA) has been initiated by the respondent authorities and is pending for disposal.
An inspection was conducted in relation to the case but the petitioner was found absent. However, she submits that matter may be relegated to the Deputy Commissioner, respondent No.2 for disposing the representation of the petitioner dated 28.10.2024 alongwith revenue case. She files a copy of the proceedings of the revenue case which is taken on record.
It is found from the copy of proceedings of revenue case that on the basis of joint application of the petitioner and three others, a revenue case has been registered being RC No.
155/GIS/2024/DC (SA) which is pending before the respondent authority.
In view of submissions advanced at the Bar, respondent No.2, Deputy Commissioner, South Andaman District, Port Blair is directed to dispose of the representation of the petitioner and others dated 28.10.2024 as well as RC No. 155/GIA/2024/DC (SA) within a period of eight weeks from the date of communication of this order upon notice to the petitioner as well as the other applicants.
Learned advocate for the petitioner is directed to communicate this order to the respondent No.2, Deputy Commissioner, South Andaman, Port Blair for necessary compliance.
With the aforesaid direction the writ petition being WPA/278/2025 is disposed of.
Since no affidavit has been called for, the allegations made in the writ petition are deemed to be not admitted. It is made clear that this Court has not gone into the merits of the application.
All connected application, if any, stand disposed of. Interim order, if any, stands vacated.
