July 01, 2025 [Manoj] Item No. 2 The affidavit of service filed today is taken on record. Learned advocate for respondent no. 1 is present. It appears that, at the instance of the writ petitioner, a demolition order was passed by the Port Blair Municipal Council against respondent no. 2. The first appeal preferred by respondent no. 2 was dismissed. He thereafter preferred a second appeal before the Lieutenant Governor, Andaman and Nicobar Islands, on October 25, 2024.

During the pendency of the second appeal before the Lieutenant Governor, respondent no. 2 filed WPA/715/2024 before this Court, which was disposed of on December 16, 2024 by a learned Single Bench of this Court, restraining the Municipal Council from proceeding further with the demolition order for a period of twelve weeks or until further orders, whichever is earlier.

The present writ petition has been filed by the petitioner, expressing grievance that he has not been made a party in the second appeal pending before the Lieutenant Governor. He, however, prays for a direction upon the Lieutenant Governor to dispose of the second appeal as expeditiously as possible.

The petitioner is unable to furnish the details and current status of the appeal pending before the Lieutenant Governor. This Court is, however, of the view that the petitioner should be granted liberty to make an application in the pending appeal, if any, before the Lieutenant Governor, seeking impleadment as a party.

Accordingly, this writ petition is disposed of by granting liberty to the petitioner to make an appropriate application before the Lieutenant Governor in connection with the pending appeal, if any.

If such an application is filed within a period of one week, the same shall be considered by the Lieutenant Governor in accordance with law.

WPA/289/2025 is disposed of accordingly.
