Kumar ... for the respondent September 27, 2024 [SR] Item No.21 The grievance of the petitioner is directed against an order dated 23 July 2022 whereby the claim of the petitioner for diversion of the land has been rejected.

It is submitted on behalf of the respondent Administration that a similar and connected proceeding being WPA/346/2022 has been disposed of on 17 August 2023 by a Coordinate Bench interalia by directing the Sub Divisional Officer to forward a Field Status Report to the petitioner after affording an opportunity of hearing to the petitioner. The Sub Divisional Officer has also been directed to complete the entire exercise within a period of eight weeks from the date of communication of the order.

In view of the order dated 17 August 2023 passed in WPA/346/2022, this writ petition stands disposed of by granting a similar direction i.e. the Sub Divisional Officer is directed to forward the Field Status Report to the petitioner and afford an opportunity of hearing to the petitioner to put forward its respective stand. The above decision is to be taken by the Sub Divisional Officer positively within eight weeks from the date of communication of this order. In view of the above, the impugned order dated 23 July 2022 stands set aside.

With the above directions, WPA/359/2022 stands disposed of. ( Ravi Krishan Kapur, J. )
