Mishra ...for the Petitioner Ms. Babita Das ...for the Respondent July 05, 2024 (M.A.Mobin) Item No.2 It is the case of the petitioner that he encroached upon the government land having survey No. 10/P measuring 1 hector situated at Manjery village under Ferrargunj Tehsil, South Andaman during 1974 and this fact has been entered into the encroachment register maintained by the concerned Patwari. In order to regularize the said land, the petitioner submitted various representations to the respondent authority. However, they failed to take any action on the same. Hence the petitioner preferred Writ Petition WPA/356/2022 and the Learned Single Judge of this Court vide order dated 26.08.2022 directed the Deputy Commissioner to dispose of the petitioner's representation. It is the case of the petitioner that the respondent initiated RC Case No. 94/LC/2022, however, till date the said case has not been disposed of.

Hence being aggrieved by the inaction on the part of the respondent, the petitioner preferred the present writ petition.

This Court has heard the arguments advanced by the learned counsel for the petitioner as well as the respondent and has perused the records.

At the outset itself, the learned counsel for the petitioner submits that he shall be satisfied at this stage if a direction be issued to the concerned authority for expeditious disposal of RC Case No. 94/LC/2022. Learned counsel for the respondent submits that the said case can be disposed of in a time bound manner.

In view thereof, the present writ petition is disposed of with a direction to the respondent to dispose of the RC Case No.94/LC/2022 as expeditiously as possible, preferably within a period of four weeks.

A copy of the final order shall be communicated to the petitioner. Needless to state the petitioner shall be at liberty to challenge the same in accordance with law. With the above direction, the present writ petition is disposed of.
