IN THE HIGH COURT AT CALCUTTA
[ CIRCUIT BENCH AT PORT BLAIR ] *** WPA/322/2024 Promila Das Vs.
The Superintending Engineer and others Mr. Ananda Halder ... for the petitioner [on behalf of Mr. S.Singha] Mr. Tulsi Lall ... for the respondents July 5, 2024 [SR] Item No.5 Petitioner contends she is in settled possession of the government revenue land. She has approached the respondent authorities to give her electricity connection but no steps have been taken.
Learned lawyer for the State-respondent submits that the petitioner has not produced documents to show that she is in settled possession on the land in question.
I have considered the materials on record. As per section 43 of the Electricity Act, a person in settled possession is entitled to electricity connection.
In view of the aforesaid, I direct the respondent no.3 to consider the representation of the writ petitioner annexed at page 15 of the writ petition and upon inspection of the site , if it is found that the petitioner is in settled possession, the said respondent shall give electricity connection to him at the earliest not later than eight weeks from the date of communication of this order. With the above direction, WPA/322/2024 is disposed of. ( Joymalya Bagchi, J. )
