Mr. Rakesh Kumar Mr. Dibesh Dwivedi ... for the respondents July 10, 2025 [SR] Item No. 7 The petitioner seeks grant of family pension in favour of one Mohd. Imran Sharif. It is submitted by the petitioner that the said Mohd. Imran Sharif is the adopted son of Late Salima Khatoon, the petitioner's sister.

It is further submitted that Mohd. Imran Sharif is mentally disabled to the extent of 60%, as certified by the competent Medical Board.

The petitioner's grievance is that, despite submitting a representation before the concerned authorities seeking release of family pension in favour of Mohd. Imran Sharif, no steps have been taken till date.

In my view, there is no justification for keeping the writ petition pending.

Accordingly, WPA/313/2025 is disposed of with a direction upon respondent no. 2, the Assistant Director, Directorate of Health Services, to consider and dispose of the

petitioner's representation within a period of two months from date, strictly in accordance with law.

It is made clear that I have not gone into the merits of the petitioner's claim, and the concerned authority shall take an independent decision on the representation, uninfluenced by any observation made herein.

Since no affidavit-in-opposition has been filed by the Administration, the allegations made in the writ petition shall be deemed to have been denied.
