Respondents Mr. P.A.Mohammed Sabib ... for the petitioner Mr. Rakesh Kumar ... for the respondents August 26, 2022 [SR] Item No.19 The petitioner is aggrieved by a rejection of his application for supply of electricity in the premises occupied by the petitioner. The rejection dated 9th August, 2022 is on the basis of the petitioner occupying the encroached land. The respondents are represented. The respondents are willing to give electricity connection to the petitioner, as submitted by learned counsel, subject to the petitioner falling within the parameters of the Full Bench judgment reported in AIR 2011 Cal 64. The Full Bench of this Court answered the reference before the Bench to the effect that the respondents shall give electricity to the writ petitioners if the applicants are found to be in settled possession of the premises in question. WPA/388/2022 is accordingly disposed of with a direction on the respondents to consider the application of the petitioner afresh within a period of three weeks from today.

The order to be passed by the respondent shall be communicated to the petitioner within one week from the date on which the order is passed by the respondent authorities and shall be within the outer limit of five weeks from today. ( Moushumi Bhattacharya, J.)
