1. Complaining non compliance of the direction dated 24th July 2023 in not disposing of the appeal filed by the petitioner on 4th May 2023 under Section 72 of the Indian Registration Act, 1908, the instant contempt application has been filed.

2. At the time of hearing of the present application both Ms. Mini, learned advocate appearing for the petitioner and Mr. Chakraborty, learned Senior Advocate appearing for the alleged contemnor jointly submit that the direction dated 24th July 2023 has since been complied with, though belatedly, by passing a reasoned order dated 9th July 2025.

3. Having considered the explanation provided by the alleged contemnor in the affidavit of compliance, though the explanation as regards the delay does not appear to be sufficient, however, I find that the

CPAN 35 of 2025 (WPA 823 of 2023) alleged contemnor has tendered apology. The apology appears to be sincere.

4. Having regard thereto, I am of the view that no fruitful purpose will be served by keeping the contempt application pending.

Accordingly the proceeding is dropped and the contempt application being CPAN 35 of 2025 is disposed of.

5. All parties shall act on the basis of the server copy of the order duly downloaded from this Court's official website.
