Vijay Kumar ... for the petitioner Ms. Babita Das ... for the respondents July 09, 2025 [Manoj] Item No. 11 The petitioner claims to be one of the beneficiaries under a Will executed by Phool Kaur (since deceased), who was the recorded owner of Survey No. 194, measuring an area of 0.0600 hectares, situated at Garacharma Village under Sri Vijaya Puram Tehsil.

The petitioner submits that he has submitted an online application in the duly prescribed form seeking mutation of the name of the beneficiaries of the Will in the relevant assessment records.

However, no further steps have been taken by the concerned respondent to effect the mutation.

Ms. Babita Das, learned advocate appearing for the respondents, submits that the writ petition is premature as the petitioner had submitted the application only on June 23, 2025. After considering the submissions made by the petitioner, this Court is of the view that the petitioner's prayer should be considered by the respondents in accordance with law within two months from the date of this order.

Needless to mention, the merit of the petitioner's claim has not been examined by this Court. The prayer for mutation shall be considered by the respondents strictly in accordance with law.

Since no affidavit-in-opposition has been filed by the Administration, the allegations made in the writ petition shall be deemed to have been denied by them.

In terms of the above, WPA/318/2025 is disposed of. ( Kausik Chanda, J. )
