S.Satyanarayana v. The Superintending Engineer And ANR
IN THE HIGH COURT AT CALCUTTA
[ CIRCUIT BENCH AT PORT BLAIR ] *** WPA/475/2023 S. Satyanarayana Vs.
The Superintending Engineer and another Mr. N. A.Khan ... for the petitioner Mr. Tulsi Lall Mr. Rakesh Kumar ... for the respondents March 16, 2023 [SR] Item No.5 The petitioner submits that he has filed an application for new electricity connection in his residence on encroached land. Learned advocate for the Electricity Department disputes this by saying that no application was filed with the department as there is no endorsement.
However, I am not entering into the dispute. I direct the Assistant Engineer, Electricity Department, to whom the application at page 10 of the writ application has been addressed, to treat this application as an application for electricity connection and to take steps for giving electricity connection to the petitioner within a period of four weeks from the date of communication of this order, subject to the applicant complying with all requisite formalities within a period of two weeks from date.
The respondent no.2 will intimate the petitioner by seven days from the date of communication of this order the
required formalities including payment of fees which are required to be complied with by the petitioner. However, this will not create any equity in favour of the petitioner in respect of the occupied land.
Supply of electricity is essential for right to livelihood under Article 21 of the Constitution of India and it cannot be denied whatever be the status of the petitioner in respect of the land.
With the above observation and direction, this writ application, being WPA/475/2023, is disposed of. ( Abhijit Gangopadhyay, J. )
