(through virtual mode) Mr. Rakesh Kumar Mr. Dibesh Dwivedi ... for the respondent 09.07.2025 [AKB] Item No.12 The petitioner has filed the present writ application praying for a direction upon the respondent authorities to direct all the vehicles specifically Trucks and Mini Cargo vehicles to weigh their load and to carry laded load before proceeding to North and Middle Andaman.

Mr. Gopala Binnu Kumar, learned counsel appearing for the petitioner submits that the petitioners being the association has constructed a weighbridge at Mile Tilak for the purpose to weigh all the trucks who are proceeding from South Andaman to North and Middle Andaman via road. Learned counsel for the petitioner alleged that some of the vehicles are carrying over and above the gross vehicle weight are not passing through the weighbridge. He submits that due to overloading of Trucks significant damaged caused to the road surface and also cause pollution.

Mr. Gopala Binnu Kumar, learned counsel for the petitioner submits that as per the provisions of the Motor Vehicle Acts and the Rules framed therein, no vehicles should be allowed to ply on the road above then the gross vehicle weight permission granted by the concerned authority. Mr. Shatadru Chakraborty, learned Senior Advocate appearing for the Administration submits that the petitioner has made representation, if a direction is passed, the authority will consider the representation and will pass the appropriate order.

Considering the submissions made by the learned counsel for the respective parties, this Court finds that the petitioner has made a detailed representation to the authorities on 19th June, 2025 which is not being disposed of till date.

Accordingly, the writ petition is disposed of by directing the respondent No. 3 being the Secretary (Transport) to place the representation of the petitioner before the Committee within two weeks from the date of receipt of this order and the Committee shall decide the same within four weeks thereafter, after giving an opportunity of hearing to the petitioner. The decision shall be communicate to the petitioner within a week thereafter. WPA/321/2025 is disposed of (Krishna Rao, J.)
